On January 1, 2022, the second phase of Ontario’s excess soil management policies came into effect, capturing a broad range of stakeholders in the construction industry, including property owners, developers, construction managers and consultants - and significantly increasing all parties’ potential liabilities as a result. Effective immediately, in addition to the initial soil management requirements introduced in January 2021, stakeholders of designated projects are now subject to additional testing, tracking, notice and report-filing requirements under the "Soil Regulations" (subject to certain limited exemptions).
