Previously used only in extraordinary cases, the Minister of Municipal Affairs and Housing has been issuing Minister’s Zoning Orders (MZOs) increasingly to expedite development that it views as aligning with government priorities, including the development of affordable housing, long-term care facilities, and other economic recovery projects. In 2020, the Minister issued more than 30 MZOs, compared to no MZOs in 2017 and 2018. These powerful tools give the Minister the authority to zone and thereby control the use of land in the province, with no chance of appeal by municipalities, citizens or environmental groups.
MZOs present both opportunities and challenges for municipalities, conservation groups and developers. While they can support and expedite the delivery of emergency response priorities, they allow the Minister to circumvent local land use planning processes and public consultations.
